In the event the Contract generation procedure with Enel Distribucion Chile or the Website registration procedure cannot be completed, your data will be used to contact you in order to facilitate the conclusion of this process.

The Response Team may access the membership form containing the data you already entered during the initial collection phase, in order to continue completing the data by phone and allow you to finalize the membership process through a link that the Response Team will send to your e-mail address.

Alternatively, access to data collection may be done by sending a “One-time password” (or “OTP”) to the mobile phone number indicated during the registration phase.

After five (5) calendar days from the delivery of this e-mail, the link will expire and the data well be canceled.

3.3. The timely delivery and updating of your personal information is necessary in all cases where data are treated in order to comply with a legal obligation or to execute a contract to which you are party or for the implementation of precontractual measures adopted at your request. An eventual refusal to deliver or update these data, could make it impossible for the Response Team to carry out the purpose for which these personal data are collected.

3.4. The timely delivery and updating of your personal information is voluntary for the purposes indicated in the chart where the legal basis for processing is your consent.  Failure to give your consent in relation to these purposes shall have no consequences upon the Contract. The obligatory or voluntary nature of consent shall be specified at the time your personal data are requested.

4. Unique Profile: Registration and Access to the Reserved Area and Social Login

You can only access the reserved area through the Enel Unique Profile. In order to continue accessing the reserved area, even registered users must accept the Terms and Conditions for the creation of a new unique profile, as it is not possible to use the previous profile.

Access to the private area is enabled through the creation of an account through the Enel Distribucion Chile web portal and mobile application, or other portals or mobile applications of Enel Group companies authorized for the creation of the Unique Profile.

4.1. Registration: the personal data are collected when the Unique Profile is created on one of the web portals or applications dedicated to this authorization. The creation of the Unique Profile allows you to access, through a unique user name and password, the web portals and mobile applications of the authorized Enel companies.

4.2. Access after registration: You can only access the reserved area through the Enel Unique Profile.

Once you have created the Enel Unique Profile, some personal data may be made available to other Group companies authorized for the Unique Profile, if you wish to access the respective reserved areas on the web portals and mobile application. The data will be processes for the sole purpose of verifying your credentials and to allow you to easily access them, without any additional charge, from any country where there is an authorized Enel company.

Access to the reserved area is permitted as follows:   

a) By creating an account through this web portal or other portals or mobile applications of Enel Group companies authorized for the creation of the Unique Profile.

b) Through the use of credentials provided by social media (“social login”), in particular, the profiles created on Facebook y Google+.

If you decide to access the reserved area through social media credentials, the Response Team will have to collect some of your personal data (first name, last name, e-mail) according to the authorizations issued by you to said social media platform. Therefore, you must verify the configuration provided by said social media platform and carefully read the related privacy policies, as they may authorize the social media platform to share your personal data with the Response Team, which authorizes the latter to collect information such as contact data, friends and other personal data. In any case, the Response Team shall have no knowledge of the registration data used.

The Response Team will keep an identification code associated with your account in the social media service in question when you use it to login to your Enel account or shall content hosted on the Website; the data will be stored for as long as necessary to provide the services requested.

If you create an account with Enel Distribucion Chile or use the Website services through social login, the Response Team may use the information contained in the account of origin to complete your profile on the Website. You may at any time update or modify the information on your profile and contact data through social login.

5. Marketing and/or Profile Creation

5.1. The e-mail address and/or home address you provide in the context of the contractual relationship established with Enel Distribucion Chile may be used by the latter to send you commercial offers related to products and/or services similar to those you have previously purchased (“soft spam”). You may at any time oppose this treatment of your data, sending a request to the e-mail provided in chapter 10 of this document.

5.2. For all matters not included in point 5.1 above, within the reserved area you can freely decide whether or not to agree to the use of your personal data for the delivery of advertising materials, direct sales, including telemarketing, the placement of products or services, commercial communications or marketing activities, and for carrying out market studies related to the products and/or services offered by Enel Distribucion Chile, the Enel Group companies, parent companies, subsidiaries and affiliates or their business partners.

5.3. Moreover, in the reserved area you can freely decide whether or not to agree to the use of your personal data by Enel Distribucion Chile, the Enel Group companies, parent companies, subsidiaries and affiliates or their business partners, for the creation of a profile of activities related to your consumption habits and information acquired from observing the use of the products or services offered, in order to provide you with personalized offers.

5.4. The processing of personal data for the abovementioned marketing purposes may be carried out using “traditional” methods (e.g., paper mail or operator calls), or through “automated” contact systems (such as SMS, MMS, automated phone calls, e-mail, fax, or interactive applications).

5.5. The consent you have given to the processing of your personal data for the abovementioned marketing purposes carried out by using automated contact systems, shall also be understood as applicable to the use of traditional contact methods. Likewise, the right to oppose the processing of your personal data for the abovementioned marketing purposes through the use of automated contact systems, shall also be understood to apply to the use of traditional contact methods, notwithstanding your recognized possibility to exercise this right only in part.

5.6. The prior obtainment of your consent to marketing and profile creation purposes as described above is not necessary when contact is made through telephone numbers (landline and/or mobile) and home addresses available from public information sources in Chile.

5.7. Consent to the abovementioned marketing and profile creation purposes is a power and does not impede the possibility of using the products or services offered by the Response Team. In particular:

a) With prior, free and specific consent, which may be granted in the reserved area under “Management of Consent,” the Holder consents to the use of his personal contact data by the Response Team in order to carry out market studies, direct sales, including telemarketing, the placement of products or services, commercial communications or marketing activities, and for delivering advertising materials, both through automated contact methods (e.g., text message, e-mail, automated phone calls) and traditional contact methods (such as paper mail, operator phone calls);

b) With prior, free and specific consent, which may be granted in the reserved area under “Management of Consent,” the personal data provided may be communicated to the Enel Group companies, parent companies, subsidiaries and affiliates or their business partners, to whom the Response Team may communicate or transfer the data acquired for the abovementioned purposes, both through automated contact methods (e.g., text message, e-mail, automated phone calls) and traditional contact methods (such as paper mail, operator phone calls);

c) Finally, subject to prior, free and specific consent, which may be issued in the reserved area under “Management of Consent,” Enel Distribucion Chile or other Enel Group companies, parent companies, subsidiaries and affiliates or their business partners may perform profile creation activities based on your consumption habits, personal data and information acquired by observing the use of the products or services offered, in order to provide you with personalized offers.

6. Personal Data Recipients

6.1. The following parties may access your personal data for the abovementioned purposes:

a) The employees and collaborators of Enel Distribución Chile and the Response Team, designated for this purpose, or of the Enel Group companies, for the performance of organizational, administrative, financial and accounting activities.

b) The employees and collaborators of external companies or other entities that carry out subcontracted activities on behalf of the Response Team in order to allow for the website to operate, acting as external parties responsible for data treatment.

c) Third parties, companies of the Enel Group, parent companies, subsidiaries and affiliates, or business partners of the Response Team, for the purposes of direct marketing, in accordance with the provisions of the applicable legislation on personal data privacy and protection, subject to the obtainment of your consent.

6.2. Customers’ personal data may be transferred to centralized and decentralizes authorities, public services and organizations, including the courts, when so required by the applicable regulations.

7. Transfer of Personal Data

7.1. Your personal data will be treated in the European Union and stored in servers located in the European Union.

7.2. These data may be treated in non-EU countries, as long as an adequate level of protection is guaranteed, recognized by a specific adequacy decision of the European Commission and shall only be possible if the owners and managers involved offer adequate contractual or extracontractual guarantees, including Binding Corporate Rules and standard contractual data protection clauses.

7.3. The transfer of your personal data to non-EU countries, in the absence of an adequacy decision or other appropriate measures as described above, shall only be done if you have given your explicit consent or in cases foreseen by the GDPR (European General Data Protection Regulation) or other appropriate measures as described above, to be carried out and treated in your interest. In these cases, we inform you that, although the Enel Group adopts operative instructions common to all countries where it operates, the transfer of your personal data could be exposed to risks related to the particularities of local laws regarding the treatment of personal data.

8. Personal Data Conservation Period

8.1. The personal data treated for the purposes established above in the Purpose and Legal Basis for Treatment chapter, shall be kept in accordance with the principles of proportionality and need, and in any case, as long as the treatment purposes remain or until they have been met.

8.2. If you have signed a contract with the Response Team, your personal data will be kept for a period of 10 years from the date of termination of the contractual relationship, notwithstanding their conservation for the purposes of meeting specific legal obligations or provisions established by the Response Team, for the collection of pending credits and the management of disputes, complaints and legal proceedings.

8.3. If you have consented to the processing of your personal data for the purposes of marketing and/or creation of the profiles mentioned in chapter 5 of this document, and you have not signed a contract with the Response Team, your personal data will be processes for the purposes mentioned, notwithstanding your right to oppose their treatment at any time, submitting a request to the e-mail mentioned in the following chapter of this document and withdrawing the consent given.

9. Interested Party Rights

9.1. By virtue of Law No. 19,628 on the Protection of Private Life, in relation to personal data communicated, you have a right to:

a) access and request a copy of the data;

b) request correction thereof;

c) request cancellation thereof

d) obtain a limitation to the treatment of your personal data;

e) oppose treatment of your personal data;

f) receive said data in a structured format commonly used and legible by digital device from another party responsible for treatment, when technically possible.

9.2. We inform you that you have a right to oppose, at any time, the treatment of any or all of your personal data.  In this case, Enel shall abstain from processing those data with respect to which you exercised your right to opposition, unless it is proven that there are legitimate binding reasons to continue with said treatment, or for the verification, compliance or defense of a right or pretension before a court of justice.

9.3. In any case, we inform you that you have the right to oppose, at any time, the processing of your personal data for direct marketing purposes, including the creation of profiles, as long as this is related to said direct marketing activities. The right to oppose this treatment through automated contact methods also applies to the processing of personal data through traditional contact methods, unless you wish to object to just one type of contact.  If you oppose the processing of your data for direct marketing purposes, your personal data will no longer be processed for these purposes.

9.4. The refusal to supply the personal data requested, or the delivery of incorrect or incomplete data, could make it impossible to adequately provide you with the contracted services. Customers are responsible for providing truthful data, as well as communicating to the Response Team and Enel any modification thereto.
